Terms of service
For using our message board/forum at www.gerenex.com and www.stud-exchange.com previous registration is necessary. The user accepts the following terms regulating the usage of the message board/forum:
1. Prohibited contents
(1) The user agrees not to use the message board for distributing illegal contents. The user assures not to post contents whose publication violates any applicable laws or prejudices rights of third parties.
(2) This applies to the following contents (numeration incomplete):
-postings containing pornographic contents or contents likely to corrupt youth
-postings containing seditious contents or contents of organisations acting contrarily to the constitution of the Federal Republic of Germany
-postings whose exploitation and publication violates copyrights, ancillary copyrights or industrial property rights (patents, brands, design and utility patents)
-postings containing advertisements for copyrighted contents like illegal software, cracked software, serial numbers, download recourses or guides to using illegal software
-postings violating personal rights of third parties, especially image, name or personality rights
-executable programs containing viruses or Trojans
-polls serving commercial purposes
2. Responsibility for contents
(1) The administrator of the message board is not liable for correctness, quality, completeness, reliability, nature or credibility of messages posted by users. The published postings do not express the opinion of the administrator; in particular, the administrator agrees not to claim the user’s contents to be his/her own.
(2) According to the provisions of the German TDG and MDStV service providers are not obliged to supervise submitted or stored information or to search for clues indicating illegal actions without reason. The service provider is only liable if
-he/she has previous knowledge about illegal actions or information,
-he/she has previous knowledge about facts or circumstances indicating illegal action or information in case of claims for damages
-he/she failed to act in time to remove information or to block access to the message board.
(3) Being informed about violations of law committed by third parties the administrator will immediately block or delete illegal postings as well as take suitable measures to prevent future violations of law.
3. Blocking postings, exclusion of users from the message board
(1) The administrator is allowed to block access to postings if there are reasonable indications that a user has used the message board contrarily to these terms or in any other way has used the message board to distribute illegal contents or contents that violate the rights of third parties.
(2) The administrator is allowed to reprimand a user if acting contrarily to these terms and to permanently exclude a user from the message board if acting repeatedly contrarily to these terms. The user’s interests are respected, especially the question if the user is liable for the breach of law.
(3) When excluded from the message board, the user is not allowed to reregister or to use the message board again using alternative names.
(4) The possibility of prosecution in case of breaches of law remains untouched. According to the law, the administrator is bound to provide the prosecution and the courts with necessary data for the purpose of prosecution.
4. Delegation of liability
(1) The user agrees to support the administrator in defending against in claims of third parties resulting from messages posted by the user, in particular, by providing the administrator with information necessary for the defence.
(2) The user is obliged to indemnify the administrator for expenditures caused by claims of third parties resulting from messages posted by the user. The user is only obliged to indemnify the administrator for expenditures if the user is liable by action or omission.
